Terms of Service

1. Acceptance of Terms

By accessing or using AtBatLab ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

AtBatLab provides AI-powered baseball mechanics analysis through video processing. The Service analyzes uploaded videos to provide feedback on pitching and batting mechanics, performance metrics, and training recommendations.

3. User Accounts

3.1 Account Creation: You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Age Requirements: You must be at least 18 years old to create an account; we ask for your birth year when you sign up. Athletes, including minors, don’t have their own accounts: a parent or legal guardian adds them as athlete profiles, or a coach adds them to the coach’s own team roster. A family and a coach see each other’s work for an athlete only after the family connects to the coach’s team. Our Children’s Privacy Notice explains how we handle athletes’ information.

3.3 Account Responsibility: You are responsible for all activity that occurs under your account.

4. Credit-Based System

4.1 Credits: Video analysis is measured in seconds of processed video. Each plan includes a monthly allotment of credits (seconds).

4.2 Credit Usage: Credits are deducted based on the trimmed duration of your video analysis. Credits reset monthly for subscription plans.

4.3 One-Time Credits: Purchased credit packages do not expire and can be used at any time.

4.4 No Refunds: Credits are non-refundable once purchased or used, except as required by law.

5. Subscription Plans

5.1 Billing: Subscription fees are charged monthly or annually in advance. You authorize us to charge your payment method on a recurring basis.

5.2 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5.3 Plan Changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of the next billing cycle.

5.4 Price Changes: We reserve the right to change our pricing.

6. Content and Data

6.1 User Content: You retain ownership of videos and content you upload. By uploading content, you grant us a license to process, store, and analyze it to provide the Service.

6.2 Content Restrictions: You may only upload content you own or have permission to use. Content must not violate any laws or third-party rights.

6.3 Storage: Uploaded videos and the processed and annotated copies we make are deleted automatically 30 days after upload. Measurements, scores, and summaries stay until you delete the athlete or your account. See the Privacy Policy.

7. Videos and Training Our Analysis (Optional)

7.1 On unless you turn it off: A small number of swing videos may be used to train AtBatLab’s own analysis models and catch analysis mistakes sooner; being included doesn’t mean a video will be used. The athlete’s account decides: a parent for a family’s athlete, or the coach for an athlete on their own roster. You can turn it off when adding the athlete or at any time in the athlete’s details, and any account member can also submit a single video.

7.2 What training uses: A training copy is a copy of the original video, so it shows the athlete. It is used only by AtBatLab to improve our analysis and never shared, sold, or used for ads. The copy the app keeps is deleted within 15 days of being chosen (or right away if training is turned off), and copies used in a training run are deleted after that run.

7.3 Saying no changes nothing else: Every feature works the same whether or not you agree to training.

7.4 In-house only: AtBatLab’s analysis models are built and trained in-house, on our own systems. We don’t send athletes’ videos or information to outside AI companies or services, and we don’t use facial recognition.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Upload content containing malware or harmful code
• Attempt to reverse engineer or circumvent any security measures
• Share your account credentials with others
• Use automated scripts or bots to access the Service
• Resell or redistribute the Service without authorization

9. Medical and Injury Disclaimer

IMPORTANT: AtBatLab provides training guidance and performance analysis only. The Service does NOT:

• Provide medical advice, diagnosis, or treatment
• Detect or predict injuries
• Replace professional medical consultation

If you experience pain or injury, consult a qualified medical professional immediately. Do not rely on AtBatLab for injury assessment or medical decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATBATLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR INJURIES RESULTING FROM USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or that analysis results will be completely accurate.

12. Intellectual Property

All intellectual property rights in the Service, including software, algorithms, analysis methodologies, and user interface, are owned by AtBatLab. You may not copy, modify, or distribute any part of the Service without written permission.

13. Termination

13.1 By You: You may delete your account at any time in Settings → Account. Deleting it permanently deletes the workspaces only you belong to, with their athletes, history, videos, and photos, as described in the Privacy Policy.

13.2 By Us: We may suspend or terminate your account if you violate these Terms or for any reason without notice.

13.3 Effect of Termination: Upon termination, your access to the Service will cease, and any remaining credits will be forfeited.

14. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the United States and the state where AtBatLab is registered, without regard to conflict of law principles.
